The Officer Duty

Section 27 of the model WHS Act is a positive, non-delegable duty. It falls on officers, which includes a chief executive, not only on the company.

Industrial manslaughter is now an offence everywhere in Australia, but a sentence has followed only in Queensland (2020, and the AU$7m record set in 2026) and Victoria (2024, on appeal 2025). South Australia has laid charges, not sentenced; the Commonwealth, NSW, and Tasmania have neither.

Section 27 asks an officer to verify that risk controls are being used and are effective, and it cannot be delegated away. ComplyFlow does not discharge that duty; nothing does.
